Dangerous Driving, Impaired Driving, Driving with over 80 milligrams is 100 milliliters of blood and refuse to provide a breath sample, all carry a 1 year driving prohibition and a criminal record. These are also very technical cases which involve Applications pursuant to the Charter of Rights. In these cases it is critical that the Crown prove that the Police Officers observed a very strict code of conduct during the investigation and arrest. Many obstacles have to be overcome by the police in order for the charges to result in convictions. It is the lawyer’s duty to insure that the police in fact did complete every stage of the investigation properly, without delay and in full compliance with the Criminal Code and the Charter of Rights and Freedoms.
